(1) The commission will have at least three members including the chairman, with at least one woman.
(2) There will be a recommendation committee chaired by the Chief Minister of the Province to recommend the appointment of the Chairman and the members, consisting of the Speaker of the Provincial Assembly and the Leader of the Opposition in the Provincial Assembly.
(3) The recommendation committee according to sub-section (2) shall make recommendations for the appointment of the chairman and members on the basis of the principle of proportional inclusion.
(4) Based on the recommendation of the committee as per sub-section (2), the head of state shall appoint the chairman and members.
(5) A Nepalese citizen with the following qualifications shall be eligible for appointment to the post of chairman or member:-
(a) Having obtained a Master's Degree from a recognized University,
(b) Not being a member of any political party at the time of appointment (c) Forty-five years in the case of the Chairman and thirty-five years in the case of members,
(d) having high moral character.
(6) Among the members of the commission, at least one member should be from among the people who have been in government service for a period of twenty years or more and the rest of the members should be engaged in research, research, teaching or any other important work in science, technology, art, literature, law, public administration, sociology or other fields of national life. They will be appointed from among the people who have gained fame.
(7) The term of office of the chairman and members shall be six years from the date of appointment.
